These Terms govern your use of the Welligo website and app. They are legally binding and must be read with the Privacy & Data Protection Policy and the Refund, Returns & Shipping Policy. The English version shall be the governing version; any Hindi summary or translation is for convenience only.

Acceptance and Eligibility

By accessing, registering on, or placing an order through the Platform, you agree to these Terms and confirm that you are at least 18 years old, legally competent to contract under Indian law, and responsible for the accuracy of your account details and the security of your login credentials.

Services and User Conduct

Welligo provides an online platform for ordering grocery, kirana and related products in serviceable areas. Product availability, prices, delivery slots, charges, offers and service areas may vary and may be changed, suspended or withdrawn at any time, subject to applicable law. Users shall not misuse the Platform, including by fraud, false information, fake orders, abuse of offers, unauthorised access, unlawful content or any activity that harms the Platform, its users or its operations. Welligo may suspend, restrict or terminate access or cancel orders where misuse, fraud or legal non-compliance is reasonably suspected.

Orders, Payments and Delivery

All product listings are invitations to offer. Your order is an offer that Welligo may accept or reject, in whole or in part, based on stock availability, delivery feasibility, pricing or system errors, operational constraints, risk checks or legal compliance. If an order is cancelled due to pricing errors, system issues, lack of stock or fulfilment problems, Welligo may refund the relevant amount within a reasonable time through the original payment method or another lawful mode, subject to banking and payment-partner timelines.

Payments may be made through UPI, cards, net banking, wallets or cash on delivery, where available, using authorised payment partners. Welligo is not liable for failures or delays caused solely by banks, gateways, UPI apps or network issues, but will reasonably assist in dispute resolution where possible. Delivery timelines are indicative only and may vary due to traffic, weather, local restrictions or other operational factors. Risk and title in the products pass to you upon delivery at the address provided in the order, against proof of delivery.

Returns and Refunds

Returns, replacements and refunds are governed by the Refund, Returns & Shipping Policy. Perishable products are generally returnable or replaceable only at delivery if visibly damaged, spoiled or incorrect, while eligible packaged products may be returned or replaced if damaged, defective, expired or materially different from the order, subject to timelines and verification. Welligo will not impose cancellation charges on a customer after order confirmation unless similar charges are also borne by Welligo when it cancels the order unilaterally, subject to applicable e-commerce rules.

Privacy and Intellectual Property

Use of the Platform is also governed by the Privacy & Data Protection Policy. By using the Platform, you acknowledge the collection and processing of your personal data in accordance with that Policy and applicable law. All content on the Platform, including text, logos, graphics, images, interfaces and software, belongs to or is lawfully licensed to Welligo and is protected by applicable intellectual property laws. Users receive only a limited, revocable, non-transferable licence for personal, non-commercial use of the Platform.

Liability and Indemnity

The Platform and all products and services are provided on an “as-is” and “as-available” basis, without warranties of uninterrupted access, error-free operation, or fitness for a particular purpose, except as required under mandatory Indian law. To the maximum extent permitted by law, Welligo’s total liability for any claim arising from the Platform or any transaction shall be limited to the amount actually paid by you to Welligo for the specific transaction giving rise to the claim. Welligo shall not be liable for any indirect, incidental, consequential, special, exemplary or punitive loss, including loss of profit, business, goodwill, data or reputation, to the fullest extent permitted by law. Nothing in these Terms excludes any liability that cannot lawfully be excluded.

To the extent applicable under law, Welligo may avail of protections, exemptions and limitations of liability available to e-commerce entities, platform operators and sellers under relevant Indian laws. You agree to indemnify and hold harmless Welligo and its directors, officers, employees and representatives against claims, losses or costs arising from your breach of these Terms, misuse of the Platform or violation of law or third-party rights.

Director Protection, Grievance and Law

All obligations and liabilities under these Terms attach only to Welligo Enterprise (OPC) Private Limited as a separate legal entity and not personally to its directors, officers, employees or representatives, including Ms. Bhagwati Pandey acting in her official capacity. No personal claim shall be pursued against any such person for good-faith acts performed in the course of official duties on behalf of the company, except to the extent not permitted by law.

Complaints will be acknowledged within 48 hours and ordinarily resolved within 30 days. These Terms are governed by Indian law, and disputes shall be subject to the exclusive jurisdiction of the courts at Pithoragarh, Uttarakhand, India. Welligo may update these Terms at any time, and continued use of the Platform after such update constitutes acceptance of the revised Terms to the extent permitted by law.
